Terms of Service — Pocket Pit

1. About these terms
These Terms of Service (Terms) apply when you use https://pocketpit.com.au (the Site) or buy goods from us.
By placing an order you agree to these Terms. Please also read our Refund Policy, Shipping Policy, and Privacy Policy.
If you do not agree, do not use the Site or place an order.
2. Who we are
Pocket Pit is the trading name of the operator of pocketpit.com.au.

In these Terms, we, us, and our means Pocket Pit. You means the person using the Site or placing an order.
3. The product
We currently offer one product: the Pocket Pit, Ultralight Portable Firepit.
As described on the Site:
- price $99.95 AUD (unless checkout shows a different current price)
- stainless construction
- about 600 g product weight; about 800 g shipping weight
- expanded size about 42 × 42 × 32 cm
- fuel capacity up to 5 kg
Images and descriptions are intended to be accurate. Minor variations in finish or appearance can occur with handmade or batch-produced metal goods. If the goods you receive are substantially different from the description, you have rights under the Australian Consumer Law (see clause 9).
We do not invent reviews or other social proof on the Site.
4. Eligibility and the Site
You must be able to form a legally binding contract. If you buy for someone else (including as a gift), the recipient has the same consumer-guarantee rights as if they had bought the goods themselves.
Sales are intended for consumers in Australia. You must be 18 or over to purchase a firepit.
We may update the Site, these Terms, prices, or product details from time to time. The Terms that apply to an order are those published on the Site when you place that order, except that we cannot exclude rights you have under the Australian Consumer Law.
You must not misuse the Site (including attempting to interfere with its security or operation, scraping it in a way that overloads it, or posting unlawful content).
5. Orders, price, and payment
Prices are in Australian dollars (AUD).
We are not registered for GST. Prices are in AUD. We do not charge GST and we do not describe prices as “including GST”. The price you pay is the product price. Shipping within Australia is free. If checkout shows a delivery charge for an address outside Australia, that charge is part of the total.
Payment is processed at checkout (cards and wallets enabled on the store). We do not store your full card details on our own servers; checkout is handled by our store platform and payment provider.
We may decline or cancel an order if:
- we cannot fulfil it
- there is an obvious pricing or listing error
- we reasonably suspect fraud or unauthorised use
- you are not in an area we ship to
If we cancel after you have paid, we will refund you in full to the original payment method.
A contract is formed when we accept your order, usually by sending an order confirmation email. That confirmation is not a promise that goods have already been dispatched.
6. Fulfilment, dropshipping, and delivery
We sell online and fulfil every order by dropshipping from our supplier as the default. Goods are packed and sent by the supplier / fulfilment partner. We do not advertise holding inventory and we do not offer local pickup.
- Dispatch: within 2 business days of payment (dropship from supplier as default).
- Delivery: typically 5–12 business days within Australia. Remote / WA / NT may take longer.
- Shipping within Australia is free.
- We do not promise next-day delivery and we do not name a specific courier.
Title to the goods passes to you once you have paid in full and the goods have been delivered. Until delivery, we remain responsible for supplying the goods you bought, including if they are lost or damaged in transit, except to the extent the Australian Consumer Law provides otherwise.
Risk of loss or damage caused by your misuse after delivery is yours.

7. Cancellations before dispatch
If you need to change or cancel an order, email pocketpit@aranburns.com as soon as you can.
If the order has not yet been dispatched, we will cancel and refund in full. After dispatch, our Refund Policy applies (change of mind and ACL).
There is no cooling-off period under Australian law for ordinary online orders you choose to place. Any change-of-mind right is a voluntary store policy, not a statutory cooling-off right.
To return an item, email us. We will send return instructions. Do not post anything until we confirm.
8. Change of mind
Our voluntary change-of-mind policy is in the Refund Policy: 30 days from delivery, unused and unburned, in original packaging. A firepit that has had any fuel burned in it is not eligible for change of mind. You pay return postage. Original outbound shipping is not refunded on a change of mind. This does not affect your ACL rights if the goods are faulty (we reimburse reasonable return costs for a confirmed ACL fault).
That store policy is in addition to, and does not replace, your Australian Consumer Law rights.
9. Australian Consumer Law — consumer guarantees
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law (ACL) that cannot lawfully be excluded. Any term that would do so is void to that extent.
In summary (see the Refund Policy for more detail):
- Goods must be of acceptable quality, match their description, and be fit for the purpose we describe.
- For a major failure, you choose refund, replacement, or compensation for the drop in value.
- For a minor failure, we may choose to repair, replace, or refund within a reasonable time. If we do not, further remedies are available to you.
- These rights apply for a reasonable time, which depends on the nature of the product — they are not limited to a 30-day window.
- We are the supplier you bought from. We will not send you only to a manufacturer for an ACL remedy we are responsible for providing.
If we offer any extra warranty against defects in future, that warranty will be in addition to the ACL, and will include the wording the law requires. We do not currently publish a separate manufacturer’s warranty period.
10. Safe use of the firepit
The Pocket Pit is a portable outdoor firepit. It uses fuel and becomes extremely hot.
Without limiting the ACL, you agree to:
- use it outdoors only, never in a tent, vehicle, or enclosed space
- not exceed 5 kg of fuel
- keep it on a stable, non-flammable surface, away from structures, dry grass, and other combustibles
- never leave it unattended while lit or hot
- keep children and pets at a safe distance
- allow it to cool completely before moving, packing, or storing it
- check local fire restrictions and not use it on total fire ban days or where open fires are prohibited
- follow any instructions supplied with the product
Misuse (including indoor use, overloading with fuel, or use during a fire ban) can cause injury, property damage, or a fire, and may mean a problem is not covered by the consumer guarantees if the problem was caused by that misuse.
11. Intellectual property
The Pocket Pit name, product design as shown on the Site, text, photographs, and other content on the Site are owned by us or licensed to us. You may view and use the Site for personal shopping. You may not copy our content for commercial use without our written permission.
12. Privacy
We handle personal information in line with our Privacy Policy (last updated 14 October 2025, unless a later version is published on the Site). Contact: pocketpit@aranburns.com.
13. Liability
This clause applies only to the extent permitted by law. It does not exclude, restrict, or modify the consumer guarantees or any other non-excludable right under the ACL. It does not apply to liability for fraud, or for death or personal injury caused by our negligence, to the extent that liability cannot be limited.
To that limited extent:
- we are not liable for loss that was not reasonably foreseeable
- we are not liable for loss caused by your misuse of the product or by your breach of these Terms
- we are not liable for delays or failures caused by events beyond our reasonable control (for example severe weather, carrier disruption, or industrial action), but this does not remove any ACL right you have if we fail to supply goods of acceptable quality or within a reasonable time
We do not limit our ACL liability for these goods to repair or replacement only. These goods are ordinarily acquired for personal, domestic, or household use.
If a court finds any part of these Terms unfair or unenforceable under the ACL (including the unfair contract terms rules), that part is read down or severed, and the rest continues.
14. Disputes
If something goes wrong, email pocketpit@aranburns.com first and we will try to resolve it.
You may also contact your State or Territory consumer protection agency, or apply to the relevant tribunal or small-claims court (for example VCAT in Victoria, NCAT in New South Wales, QCAT in Queensland, or the equivalent where you live). You can report issues to the ACCC, which does not usually resolve individual disputes but uses reports in its compliance work.
15. Governing law
These Terms are governed by the laws of Victoria, Australia, and the Australian Consumer Law as it applies nationally.
This choice of law does not prevent you from using the courts or tribunals of the Australian State or Territory in which you live, and it does not limit your ACL rights.
