Your rights under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Those consumer guarantees apply automatically. Nothing in this policy, our Terms of Service, or anything else we say or do takes them away. A “no refunds” rule, a time limit on this page, or a change-of-mind condition does not limit your ACL rights if the goods fail to meet a consumer guarantee.

In plain English, when you buy a Pocket Pit from us you can expect that it:

  • is of acceptable quality — safe, durable, free from defects, and with an acceptable appearance and finish, taking into account the nature of the product, its price, and what we say about it
  • is fit for the purpose we describe (an ultralight portable firepit) and any particular purpose you told us about before you bought it, if it was reasonable for you to rely on us
  • matches the description and any sample or demonstration on our website
  • comes with clear title (you own it)

Major failure

A problem is generally a major failure if the firepit:

  • is unsafe
  • is substantially different from the description
  • has a serious problem, or several smaller problems, that would have stopped a reasonable person buying it if they had known
  • cannot be used for its normal purpose (or a purpose you told us about before buying) and cannot easily be fixed within a reasonable time

If there is a major failure, you choose the remedy: a refund, a replacement of the same type of product, or to keep the product and be compensated for the drop in value. A refund for a major failure is the full amount you paid. We will not deduct an amount for use. We will refund you in the same way you paid, unless we agree otherwise.

You may also be entitled to compensation for other reasonably foreseeable loss or damage.

Minor failure

If the problem is not a major failure, we will fix it within a reasonable time. For a minor failure we may choose to repair, replace, or refund. If we cannot or will not fix a minor failure within a reasonable time, you may then reject the goods for a refund or replacement, or have the failure remedied elsewhere and recover reasonable costs from us.

When the consumer guarantees do not require a remedy

We are not required to repair, replace, or refund under the consumer guarantees if:

  • you simply changed your mind, found it cheaper elsewhere, or decided you did not like it or had no use for it (unless our change-of-mind policy below applies)
  • you caused the problem by misusing the product (for example, using it contrary to the product instructions, exceeding the stated fuel limit, or using it indoors)
  • you knew of, or were clearly told about, the particular problem before you bought it

Used or burned firepits can still be covered by the ACL if they fail to meet a consumer guarantee (for example, a safety or manufacturing fault). Use does not cancel those rights.

Change of mind (optional store policy)

Australian law does not give a cooling-off period for ordinary online purchases you choose to make. The cooling-off rules for unsolicited consumer agreements (such as some door-to-door or telemarketing sales) do not apply to orders you place on our website.

We offer a voluntary change-of-mind return as a store policy, in addition to your ACL rights.

30-day unused, unburned returns

You may return a Pocket Pit for a change-of-mind refund if all of the following apply:

  1. You email us at pocketpit@aranburns.com within 30 days of delivery.
  2. The firepit is unused and unburned — no fuel of any kind has been lit in it, and it has not been used outdoors as a firepit.
  3. It is in original condition, with original packaging and all included parts.
  4. You can provide proof of purchase (order number or receipt).

A firepit that has had any fuel burned in it is not eligible for change of mind. That does not affect your ACL rights if the product is faulty.

Change-of-mind refunds are for the product price paid ($99.95 AUD if that is what you paid). Original outbound shipping is not refunded on a change of mind. You pay return postage for a change of mind.

We do not offer store credit only as a substitute for a refund where you are entitled to a refund under this policy or the ACL.

How to request a return or a remedy

Email pocketpit@aranburns.com with:

  • your order number and name
  • whether this is a change of mind or a problem with the product (fault, damage, missing parts, not as described)
  • photos if the goods are damaged, faulty, or not as described
  • the outcome you are seeking (refund, replacement, or repair)

We may ask questions or request photos so we can assess the issue. We are entitled to assess the product before providing an ACL remedy.

Do not post the firepit back until we confirm the return. Email us first. We will send return instructions if a return is approved.

Return shipping

  • Change of mind: you arrange and pay return postage, unless we agree otherwise. The Pocket Pit is a light parcel (listed shipping weight about 800 g), so it can usually be posted as an ordinary parcel.
  • ACL (fault, not as described, damaged on arrival, or other consumer-guarantee failure): you may return the goods if they can reasonably be posted. If we confirm there is a problem that we are responsible for under the ACL, we will reimburse reasonable return postage (keep your receipt). If the goods are not reasonably returnable by post, we will arrange collection at our cost within a reasonable time.
  • If we collect or inspect the goods and find there is no problem we are responsible for, we may ask you to pay reasonable collection and inspection costs — but only if we gave you a reasonable estimate of those costs before collecting the goods.

Pack the firepit so it will not be damaged in transit. We recommend using the original packaging where you still have it. Original packaging is not required for an ACL return.

Refunds and replacements

  • ACL refunds for a major failure are in full for the affected goods, in the same payment method unless we agree otherwise, and include any delivery charges you paid for those goods where a refund of the goods is the remedy.
  • Change-of-mind refunds: see above.
  • We will process approved refunds within 10 business days after we receive the returned goods and complete any assessment. Your bank or card issuer may take extra time to show the credit.
  • Replacements, if provided, will be the same type of product where reasonably available. Consumer guarantees that applied to the original goods apply to replacement goods.

Proof of purchase

Please keep your order confirmation email. We may ask for your order number, receipt, or other reasonably sufficient proof of purchase.
